1. Introduction

Welcome to Shemeza Safari Escapes. These Terms and Conditions govern your use of our website located at www.shemezasafariescapes.com ("Site") and the safari services ("Services") offered by Shemeza Safari Escapes ("we," "our," or "us").

By accessing our Site and using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our Site or Services.

2. Acceptance of Terms

By making a booking with Shemeza Safari Escapes, you confirm that you have the authority to accept these Terms and Conditions on behalf of yourself and all members of your party. The lead person on the booking is responsible for ensuring that all members of the party are aware of and accept these Terms and Conditions.

You must be at least 18 years of age to make a booking. If you are under 18, you must have permission from a parent or guardian to make a booking, and they must accept these Terms and Conditions on your behalf.

3. Booking Process

3.1 Booking Request

To make a booking, you must complete our booking form on the Site or contact us directly. All booking requests are subject to availability and confirmation by Shemeza Safari Escapes.

3.2 Booking Confirmation

A booking is confirmed only when you receive a written confirmation from us, usually via email. Before this confirmation, no contract exists between you and Shemeza Safari Escapes.

3.3 Booking Information

You are responsible for providing accurate and complete information when making a booking. This includes:

  • Full names as they appear on passports
  • Valid contact information (email and phone number)
  • Special requirements or medical conditions
  • Dietary restrictions

Inaccurate or incomplete information may result in additional charges, delays, or cancellation of your booking.

4. Payment Terms

4.1 Deposit

To secure your booking, a non-refundable deposit of 30% of the total safari cost is required at the time of booking confirmation.

4.2 Final Payment

The remaining balance must be paid no later than 60 days before the safari start date. For bookings made within 60 days of the safari start date, full payment is required at the time of booking.

4.3 Payment Methods

We accept the following payment methods:

  • Credit/debit cards (Visa, MasterCard, American Express)
  • Bank transfers
  • PayPal

All payments are processed in US Dollars (USD). Any bank charges or currency conversion fees are the responsibility of the client.

4.4 Price Guarantee

Once your booking is confirmed and the deposit is paid, the price of your safari is guaranteed against any surcharges, except for:

  • Government action or increases in taxes or compulsory charges
  • Currency fluctuations exceeding 5% from the time of booking
  • Increases in park fees or conservation charges imposed by the Ugandan government

We will absorb any increase equivalent to 2% of the price of your safari. Any increase above 2% will be charged to you. If this means paying more than 8% of the original safari price, you will have the option to cancel with a full refund of all monies paid.

5. Cancellation Policy

5.1 Cancellation by You

If you need to cancel your safari, the following cancellation fees apply:

  • More than 60 days before safari start date: Loss of deposit (30% of total safari cost)
  • 30-59 days before safari start date: 50% of total safari cost
  • Less than 30 days before safari start date: 100% of total safari cost (no refund)

All cancellations must be made in writing to booking@shemezasafariescapes.com. The date of receipt of the cancellation notice will determine the applicable cancellation fees.

5.2 Cancellation by Us

We reserve the right to cancel your safari in the following circumstances:

  • Failure to make payments according to the payment schedule
  • Provision of incorrect or incomplete information that affects the safari arrangements
  • Force majeure events (as defined in Section 10)
  • Insufficient participants for a group safari (we will notify you at least 30 days before the safari start date)

If we cancel your safari (except due to your failure to comply with these Terms), we will offer you the choice of:

  • A full refund of all monies paid
  • An alternative safari of comparable standard, if available (if the price is lower, we will refund the difference; if higher, you will need to pay the difference)

6. Travel Insurance

Travel insurance is mandatory for all clients of Shemeza Safari Escapes. Your travel insurance must provide coverage for:

  • Medical expenses and emergency repatriation
  • Personal liability
  • Cancellation and curtailment
  • Loss of luggage and personal effects

We strongly recommend that your insurance also covers:

  • Adventure activities (such as gorilla trekking)
  • COVID-19 related disruptions
  • Political evacuation

You must provide proof of adequate travel insurance at least 30 days before your safari start date. If you fail to provide proof of insurance, we reserve the right to cancel your booking with applicable cancellation fees.

7. Passport & Visa Requirements

You are responsible for ensuring that you have valid travel documents, including:

  • A passport valid for at least 6 months beyond your planned return date
  • Appropriate visas for Uganda and any other countries you will visit
  • Any required vaccinations and health certificates

We will provide general information about visa requirements for Uganda, but it is your responsibility to check the specific requirements based on your nationality and circumstances. We are not liable for any issues arising from inadequate travel documents.

8. Health & Safety

8.1 Medical Conditions

You must inform us of any medical conditions, disabilities, or mobility issues that may affect your safari experience. We will make reasonable efforts to accommodate special needs, but some activities may not be suitable for all participants.

8.2 Vaccinations

You are responsible for obtaining any required or recommended vaccinations for Uganda. This may include yellow fever, which is mandatory for entry into Uganda. We recommend consulting with a travel health professional at least 8 weeks before your safari.

8.3 Safety Guidelines

For your safety, you must follow all instructions given by our guides and staff. Wildlife viewing involves inherent risks, and you must adhere to safety protocols at all times. Failure to follow safety guidelines may result in exclusion from activities without refund.

9. Limitation of Liability

Shemeza Safari Escapes acts as an agent for transportation companies, hotels, lodges, and other service providers. We are not liable for:

  • Any injury, loss, damage, accident, delay, or irregularity resulting from defect in any vehicle, act of God, war, terrorism, strike, theft, or any other cause beyond our control
  • Acts or omissions of any third-party service providers
  • Changes to itineraries or accommodations necessitated by circumstances beyond our control
  • Any loss or damage to personal belongings
  • Any personal injury or death that is not due to our negligence

Our liability for claims not involving personal injury, illness, or death is limited to the cost of the affected services. In no event shall our liability exceed the total amount paid for the safari.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control. These include, but are not limited to:

  • Natural disasters (floods, earthquakes, storms)
  • Acts of government or authority
  • War, terrorism, or civil unrest
  • Epidemics or pandemics
  • Strikes or labor disputes
  • Transportation disruptions

In such circumstances, we reserve the right to:

  • Cancel or modify your safari
  • Offer alternative arrangements
  • Issue credits for future travel instead of refunds

11. Modifications to Itineraries

We reserve the right to modify safari itineraries before or during the safari due to:

  • Weather conditions
  • Wildlife movements
  • Park regulations or closures
  • Road conditions
  • Accommodation availability
  • Other circumstances affecting safety or experience quality

We will make reasonable efforts to provide services of equal or similar standard. No refunds will be given for reasonable modifications to itineraries.

12. Intellectual Property

All content on our Site, including text, graphics, logos, images, audio clips, and software, is the property of Shemeza Safari Escapes or its content suppliers and is protected by Ugandan and international copyright laws.

You may not reproduce, distribute, display, or create derivative works from any content on our Site without our express written permission.

13. User-Generated Content

By sharing photographs, reviews, or other content related to your safari experience with us, you grant Shemeza Safari Escapes a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and distribute such content for marketing and promotional purposes.

You represent that you have the right to grant such a license and that your content does not violate any third-party rights or applicable laws.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Uganda. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda.

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our Site. Your continued use of our Site or Services after any changes indicates your acceptance of the modified Terms.

For bookings already confirmed, the Terms and Conditions in effect at the time of booking confirmation will apply, unless you expressly accept the updated Terms.
